Terms
These product-specific Terms supplement the Apple Standard EULA.
1. Acceptance and application
By acknowledging the in-app notice and using Anesthesia Memo, you agree to these Terms, the Privacy Policy, and the applicable Apple EULA. Do not use the app if you do not agree. A material change may require a new in-app acknowledgement.
2. Purpose and audience
Anesthesia Memo supports manually entered personal notes, times, vital signs, medication and event records, IN/OUT organization, and self-review. It does not provide diagnosis, treatment, medication orders, dose selection, patient-specific recommendations, or automated clinical decisions. The app is intended for adult healthcare professionals or trainees acting with appropriate authorization and supervision.
Facility-specific dilution concentrations are optional, user-confirmed record settings for manual transcription into a medication log. A user may choose not to use facility settings for a case. The values are not recommended concentrations, remain hidden from the intraoperative screen until confirmed by the user, and are not used to calculate a dose or infusion rate.
Time records are based on the device clock or manual edits. Editing a saved time requires an explicit save action, and corrections or removals may appear in a supplementary change history. This history is not a tamper-resistant audit trail, certified timestamp, or proof of the actual time of a clinical action.
Use of the app does not create a clinician-patient, treatment, supervisory, or other professional relationship with the developer, and does not transfer to the developer any duty owed by a healthcare professional or institution.
3. License and intellectual property
Subject to these Terms and the Apple Standard EULA, you receive a limited, non-exclusive, non-transferable, non-sublicensable right to use the app for personal and lawful purposes. Rights in the app, its presentation, text, structure, and software remain with the developer or applicable rights holders.
4. In-app purchase and restoration
The app is free to download. Core recording, editing, on-device storage, and single-case export are available without a purchase. The optional Anesthesia Memo Pro non-consumable in-app purchase adds multiple facility profiles, multiple supervisor labels, bulk export of all cases, encrypted backup, and facility-profile import and export. It is not a subscription and has no recurring charge.
The app may offer optional consumable in-app purchases for users who want to support continued development. These purchases support maintenance, improvements, and continued availability of Anesthesia Memo. They are not charitable donations. Support purchases do not unlock Anesthesia Memo Pro, change recording features, affect saved data, change export or backup access, or otherwise change the app's terms of use. They do not grant a Pro entitlement and are not treated as a permanent restorable right.
Price, applicable tax, and purchase confirmation are shown by the App Store. Payment and refund requests are handled under Apple's terms and procedures. A previous purchase can be restored in the app with the same Apple Account. Purchase or restoration may be unavailable because of Apple Account, App Store, compatibility, or eligibility conditions.
If the entitlement cannot be retrieved, or if Pro access is revoked after a refund or for another reason, saved cases and settings and the facility profiles and supervisor labels created while Pro was active remain viewable and editable. Adding items beyond the free limits, bulk export of all cases, creation of new encrypted backups, and facility-profile import or export remain unavailable until Pro access is restored. Pro does not add clinical decision support, patient-specific recommendations, alarms, or official-record functionality.
5. Prohibited use
- Do not use the app as an official anesthesia record, medical chart, patient monitor, alarm, medical device, emergency communication method, or sole basis for diagnosis, treatment, medication, dose selection, patient-specific recommendations, or clinical decisions.
- Do not enter, export, back up, or publicly post patient-identifiable information.
- Do not enter a personal name as a supervisor label without confirming necessity and local policy. Do not post patient, staff, or facility identifiers to public support.
- Do not use the app unlawfully, in violation of professional or institutional duties, to infringe rights, or to impair its security or integrity.
6. User responsibility
Verify entries, times, units, and displays against approved records, patient monitors, local procedures, and responsible clinical judgment. You are responsible for direct patient assessment, device security, backups, exports, retention, institutional authorization, and legal compliance.
7. Data and public posts
Case data is stored on the device and may be lost or transferred through device failure, OS updates, app deletion, backups, or sharing. Keep required official records in an approved system and do not use the app as their only storage location.
A readable personal export may include case dates, free text, medication and event records, IN/OUT, and display labels. The identifier-reduced sharing copy omits selected high-risk fields but does not guarantee anonymity or prevent re-identification. Review the content and destination before export.
A facility-settings file contains the facility alias, entered concentrations, and the unit. An official facility name is unnecessary. Review the alias and destination before sharing. Imported facility settings are added as unconfirmed; verify them against local procedure and the actual medication label before marking them confirmed.
Store the encrypted-backup recovery key or passphrase separately in a secure location. Recovery may fail because of a lost or mistyped key, damaged file, or unsupported format. The developer does not retain keys and cannot reissue a lost key or decrypt the backup. Recovered TXT and JSON files are not encrypted.
A supervisor entry is an optional display label entered by the user. Follow local policy and use initials, an alias, or a role label when a personal name is unnecessary. You are responsible for the label and any export or backup containing it. GitHub Issues are public and are not used for patient-specific, emergency, diagnostic, medication, or clinical-management advice.
8. Accuracy, availability, and liability
Input delays, input or unit errors, display errors, device or OS failures, delayed or failed storage, data loss, and unavailability may occur. Completeness, accuracy, availability, and fitness for a particular purpose are not guaranteed. Display or storage is not guaranteed to complete by a particular time, and recorded content is not guaranteed to match the actual clinical action or patient condition. The app is not represented as satisfying medical-device approval, institutional adoption, record-retention, or other legal requirements.
To the maximum extent permitted by applicable law, the developer is not liable for indirect, incidental, special, or consequential damages, lost profits, or data loss arising from use or inability to use the app. This limitation does not apply to wilful misconduct or gross negligence, or exclude non-excludable rights, remedies, or liabilities under consumer-protection or other applicable law.
9. General
If a provision is invalid or unenforceable, the remaining provisions remain effective. The applicable Apple Standard EULA controls in the event of conflict. Except where mandatory law provides otherwise, these Terms are governed by the laws of Japan, and the Tokyo District Court has exclusive jurisdiction as the court of first instance.
10. Changes and termination
The app or these Terms may be changed, suspended, or discontinued for functional, safety, legal, or distribution reasons. Material changes may be shown by a new version/date or require a new in-app acknowledgement.
